Probate and Contentious Probate

Dealing with an estate is often an emotional time, our estate team can help to simplify the process.  Whether there is a Will or the individual has died without a Will (intestate) our team can guide you through the process.  Tahina Akther leads the team with over 20 years experience as a Barrister dealing with some of the most difficult contentious and non-contentious matters.

Probate

Most estates that have a Will are straightforward to administer.  From compiling estate accounts, completing the relevant inheritance tax returns including IHT 400 series forms through to applying for probate we can help you every step of the way.

We can also assist with setting up any Trusts created by the Will, ensuring they are correctly registered and that the Trustees understand their responsibilities.

Sometimes Will's are not clear and we are able to provide a clear interpretation of the wording for executors and beneficiaries.

We can also help clients vary provisions under a will via a deed of variation.

Intestacy

Not everyone has a Will, and even where one exists it may not be valid.  Invalid Wills often fail to have signatures on them or were not witnessed correctly, however there may be other reasons for a Will failing.

Where a person dies without a valid Will the Law of Intestacy will apply.  This dictates who will inherit from the estate.  We can help explain his and who can apply for letters of administration to deal with the estate.

Intestate estates do no have to be complicated, we can help.
